Dissolution of Marriage

You or your spouse begins the process by petitioning the Court for dissolution of the marriage and to distribute between the two parties the rights and responsibilities they had as a couple. There is then a requirement by the other spouse to answer the petition, admitting or denying the allegations about custody and property distribution. A residency requirement must be met in order to file in Florida.

There is no recognition of separation (or desertion) in Florida. Florida is a “no fault” state, but an adulterous relationship can affect support awards, asset distribution or custody awards.
